Search, Seizure, Arrest and Detention Under the Canadian Charter of Rights

Understanding your rights under the Canadian Charter of Rights and Freedoms before you ever need them is the most useful legal knowledge you can have.

The Rights You Need to Know

  • 10(a)

    When arrested or detained, you must be told promptly why.

  • 10(b)

    You have the right to retain and instruct a lawyer without delay and to be told of that right.

    You have the right to remain silent. You are not required to answer questions from police.

    You have the right to be secure against unreasonable search and seizure. Police must have lawful authority to search you, your vehicle, or your home.
