Can a Peace Bond Resolve a Domestic Assault Charge in Calgary?

By ·October 13, 2026·5 min read

It is the first question most clients ask once the initial panic subsides: is there a way out of this that does not leave me with a criminal record?

On a domestic file, the most common answer is a peace bond. It is not available in every case, it is not free of consequences, and it is not something the complainant can hand you. But in the right circumstances it ends the prosecution without a conviction, without a guilty plea, and without a finding that you did anything at all.

What a peace bond actually is

A peace bond under s. 810 of the Criminal Code is a recognizance, a promise to the court to keep the peace and be of good behaviour, usually for twelve months, on conditions. It rests on the informant’s reasonable fear of injury to themselves, an intimate partner or a child, or of damage to property. It is not a finding of guilt.

When one resolves a criminal charge, the sequence is: you enter into the recognizance, and the Crown withdraws the charge. There is no conviction, no sentence and no criminal record. Our general guide to peace bonds in Alberta covers the mechanics; what follows is how they work specifically on domestic files, where Crown policy is considerably tighter.

There is also a common law peace bond, which draws on the court’s inherent jurisdiction and offers more flexibility on duration and terms. Which one is appropriate is a strategic question, not a formality.

Where Crown prosecutors in Calgary will consider one

There is no entitlement to a peace bond, and on domestic files the Crown’s domestic prosecutions unit applies real scrutiny. Factors that tend to support one:

  • No injury, or injury at the very low end
  • No prior record, and no prior domestic involvement
  • No weapon, no strangulation, no children present during the incident
  • Evidentiary weakness: a recanting or reluctant witness, no independent corroboration, inconsistent statements
  • Counselling or a domestic violence programme already completed, not merely promised
  • Stable employment, community ties, and a realistic account of what happened

Factors that usually close the door: any allegation of choking or suffocation, a history of breaches, a prior domestic conviction, or an allegation involving a child.

Note what is absent from both lists. The complainant’s wish to see the charge dropped is a consideration, not a decision, as we explain in Can a Victim Drop Criminal Charges in Alberta?

What you are agreeing to

You do not admit guilt. You will usually be asked to acknowledge that the complainant has reasonable grounds for their fear, or to accept the Crown’s concerns as a basis for the order. Counsel’s work is in the wording of that acknowledgement, because it can follow you into a family law file.

Expect conditions along these lines: keep the peace and be of good behaviour, no contact direct or indirect with the complainant, attend and complete counselling, no weapons, and sometimes a cash amount pledged but not paid unless you breach.

The costs people underestimate

Twelve months of exposure. A breach under s. 811 is a criminal offence in its own right, prosecutable by indictment with a maximum of four years. Someone who resolved an assault allegation without a record can still end up with one by answering a phone call in month eight and then choosing to continue the conversation rather than hanging up.

Nobody can release you early. If you and your partner reconcile, the no-contact term still binds you until it is formally varied by the court.

It is not invisible. The charge and the disposition are recorded in police databases. For travel to the United States in particular, an entry showing a domestic arrest can generate questions at the border even where there was no conviction, which is a reason to get advice before travelling, not a reason to avoid the resolution.

For permanent residents and foreign nationals, the point cuts the other way: because there is no conviction, a peace bond generally avoids the immigration consequences that a conviction for an offence of violence can trigger. Anyone in that position should have their immigration exposure assessed before agreeing to any resolution.

How the file gets positioned for one

Peace bonds are not requested at the last minute; they are built toward from the first week. What moves a Crown is a package: counselling already underway, a carefully drafted letter identifying the weaknesses in the disclosure, character material, and a client who has complied perfectly with release conditions in the meantime. Compliance is itself the argument: it is difficult to advance a low-risk position while a breach charge sits on the file.

It is also worth naming the alternative honestly. A peace bond is not the best outcome in every case. Where the Crown’s evidence does not hold, the right answer may be a trial and an acquittal, or a withdrawal with no conditions at all. Agreeing to twelve months of terms on a file that should have collapsed is a poor trade.
